Our client was traversing from one run to another on her snowboard when she lost a toe edge at a low rate of speed and clipped some tree branches. In the process, the lens of her snow goggles ejected, while the snow goggle frames remained intact and still strapped to her face. As a result, a twig impaled her right eye, causing the permanent loss of that eye. Through intense litigation, investigation and expert analysis, we found that the snow goggles were defective. Right before trial we settled with the goggle designer/manufacturer.
