Our client was a newborn that was given up for adoption. Her foster mother put her in a bathtub with another five-year-old child. She placed her in a seat directly under running water. She then left the room at which time the five-year-old turned the water up to scalding hot. Minutes later the foster mother returned, but it was too late, our client had suffered severe third-degree burns, which almost killed her, and resulted in a long hospitalization and extensive scarring. We were able to settle for the foster family’s homeowner’s insurance policy limits, as well as the policy limits of the Foster Family Home and Small Family Home Insurance Fund.
