Our elderly client had surgery on his spine. Due to the surgery, he was at high risk of developing blood clots in his legs if his healthcare providers did not provide him the necessary preventative care. Unfortunately, he was transferred to a nursing home, where the staff failed to get him out of bed for several days. As a result, blood clots formed and travelled to his lungs, killing him. Liability was staunchly contested and the defense argued that this was medical malpractice only with capped damages. On the eve of trial, we were able to settle the case and get a great result for our client’s mother, who survived him.
